Trademark Battles: US Polo Association Vs. Ralph Lauren
Most people are familiar with the polo player mark found on all Ralph Lauren products, be it a shirt of a scent of perfume. Not quite as many may be familiar with the logo of the United States Polo Association representing the exact same sport a very different way. Now, the battle of the mark has raged between these two groups.
Ralph Lauren's logo features a single rider stand on his stirrups while holding his stick in the air in a "ready to hit the ball" poses.The U.S. Polo Association logo, the other is 2 riders, one with a bat in the air and the other to reach to hit the ball.
The United States Polo Association has filed a complaint against Ralph Lauren saying that the fashion giant is trying to make money the logo and the sport itself. The trial comes as the United States Polo Association seeks to market its own line of perfumes.
A New York judge does not see things quite the same way as the Polo Association, though.Federal Judge Robert Sweet noted that Ralph Lauren has been the use of one polo player logo in conjunction with 'polo' the word about its products since 1978. He said that although there is plenty of room for both companies to engage in licensing activities, "it is quite another matter for the Association of the United States Polo" use "polo" in collaboration with the double horsemen mark on perfumes. "According to the judge, such use would cause confusion among consumers. Sweet Justice issued a permanent injunction requiring the association polo drop all claims.
